四　母船式漁業について第一号又は第二号の規定により許可又は起業の認可が申請された場合において、従前の母船若しくは独航船等を当該母船式漁業に使用することを廃止し、又は従前の母船若しくは独航船等が滅失し若しくは沈没したため従前の母船と同一の船団に属する独航船等又は従前の独航船等と同一の船団に属する母船に係る母船式漁業の許可又は起業の認可がその効力を失つたことにより、その許可又は起業の認可を受けていた者が、当該許可若しくは起業の認可に係る独航船等若しくは母船又はこれらに代えて他の独航船等若しくは母船を当該申請に係る母船と同一の船団に属する独航船等又は当該申請に係る独航船等と同一の船団に属する母船として許可又は起業の認可を申請したとき。例文帳に追加

２　母船式漁業の許可を受けようとする者であつて現に母船又は独航船等を使用する権利を有しないものは、母船若しくは独航船等の建造に着手する前又は母船若しくは独航船等を譲り受け、借り受け、その返還を受け、その他母船若しくは独航船等を使用する権利を取得する前に、母船及び独航船等ごとにそれぞれ、あらかじめ起業につき農林水産大臣の認可を受けることができる。例文帳に追加
