第一条　この法律は、ヒト又は動物の胚又は生殖細胞を操作する技術のうちクローン技術ほか一定の技術（以下「クローン技術等」という。）が、その用いられ方のいかんによっては特定の人と同一の遺伝子構造を有する人（以下「人クローン個体」という。）若しくは人と動物のいずれであるかが明らかでない個体（以下「交雑個体」という。）を作り出し、又はこれらに類する個体の人為による生成をもたらすおそれがあり、これにより人の尊厳の保持、人の生命及び身体の安全の確保並びに社会秩序の維持（以下「人の尊厳の保持等」という。）に重大な影響を与える可能性があることにかんがみ、クローン技術等のうちクローン技術又は特定融合・集合技術により作成される胚を人又は動物の胎内に移植することを禁止するとともに、クローン技術等による胚の作成、譲受及び輸入を規制し、その他当該胚の適正な取扱いを確保するための措置を講ずることにより、人クローン個体及び交雑個体の生成の防止並びにこれらに類する個体の人為による生成の規制を図り、もって社会及び国民生活と調和のとれた科学技術の発展を期することを目的とする。例文帳に追加

Article 1 The purpose of this Act is, in light of the risk that certain techniques including the Cloning Techniques (hereinafter referred to as the "Cloning Techniques, etc." ) among the techniques for manipulating Embryos or Germ Cells of a human or an Animal could, depending on the way they are applied, create an individual with the same gene structure as a certain individual (hereinafter referred to as a "Human Clone Individual" ) or an individual which cannot be clearly classified as a human or an Animal (hereinafter referred to as an "Hybrid Individual" ), or artificially create other similar individuals, and have a serious influence on the preservation of human dignity, safety for human life and body, and maintenance of public order (hereinafter referred to as the "Preservation of Human Dignity, etc." ), to prevent creation of Human Clone Individuals and Hybrid Individuals and to regulate artificial creation of individuals similar to them by means of prohibiting transfer of Embryos produced by the Cloning Techniques or Specified Fusion/Aggregation Techniques among Cloning Techniques, etc. into a human or Animal uterus, regulating production, receipt by assignment and import of Embryos created by Cloning Techniques, etc., and taking other measures for securing appropriate handling of such Embryos, thereby ensuring the development of science and technology in harmony with society and citizens lives.発音を聞く  - 日本法令外国語訳データベースシステム

(2) 次に掲げる生物工学上の発明は，特許による保護を受けることができない。 1) 人をクローン増殖するための方法 2) 人の生殖細胞系遺伝子的同一性を改変する方法 3) 人工授精及び胚の保護に関する法律(RT I 1997, 51, 824; 2003, 18, 102)によって禁止されている方法を含め，人の胚を商業的な目的で利用する方法 4) 動物の遺伝子的同一性を改変する方法であって，人又は動物に実質的利益をもたらすことなく，動物に害をもたらす虞のあるもの及びそのような方法から生じる動物 5) 生物材料を誘導する又は植物若しくは動物の品種を生産するための本質的に生物学的な方法。ただし，微生物を誘導するための微生物学的方法を除く。 6) 利用が単一の植物又は動物の品種に限定されている発明例文帳に追加

(2) The following biotechnological inventions shall not be protected by a patent: 1) processes for cloning human beings; 2) processes for modifying the germ line genetic identity of human beings; 3) uses of human embryos for commercial purposes, including processes prohibited by the Artificial Insemination and Embryo Protection Act 4) processes for modifying the genetic identity of animals which are likely to cause them suffering without any substantial benefit to man or animal, and animals resulting from such processes; 5) essentially biological processes for the derivation of biological materials or the production of plant or animal varieties, except microbiological processes for the derivation of micro-organisms; 6) inventions the application of which is confined to a single plant or animal variety.発音を聞く  - 特許庁

特許は次に掲げるものには付与されない。その商業的利用が公序良俗又は道徳原則に反する発明，すなわち，人クローンの創造のための過程，人の生殖系列遺伝子的同一性を変更するための過程，工業的若しくは商業的目的のために人の胚を使用する過程又は動物の遺伝子的同一性を変更するための過程で，人若しくは動物一般にも，また当該過程から発生する動物にも顕著な医学的利益をもたらすことなくそれらに苦しみを与える可能性の高いもの。ただし，公序良俗又は道徳原則との矛盾は，単に当該発明の実施が法規によって禁止されるとの事実のみから帰結されるべきものではない。形成又は成長の様々な段階における人体及び，遺伝子の配列の全体又は一部を含め，かかる人体の何らかの要素の単なる発見。ただし，遺伝子の配列の全部又は一部を含め人体から分離されるか又はその他技術的過程によって創造される要素は，その構造が自然に存在する要素と同一の場合であっても特許の対象となる。及び植物の品種，動物の種，若しくは植物又は動物の生産に係る本質的に生物学的な過程。例文帳に追加

Patents shall not be granted to inventions, whose commercial exploitation would be contrary to public policy or to principles of morality, namely to processes for cloning human beings, processes for modifying the germ line genetic identity of human beings, processes of using human embryos for industrial or commercial purposes or processes for modifying the genetic identity of animals, which are likely to cause them suffering without any substantial medical benefit to man or animal, and also to animals resulting from such processes; however, the contradiction to public policy or to principles of morality shall not be deduced merely from the fact that the exploitation of the invention is prohibited by legal regulation, human body at various stages of its formation and development, and the simple discovery of one of its elements, including the sequence or partial sequence of a gene; it does not apply to an element isolated from the human body or otherwise produced by means of a technical process, including the sequence or partial sequence of a gene, even if the structure of that element is identical to that of a natural element, and plant and animal varieties or essential biological processes for the production of plants or animals.発音を聞く  - 特許庁
