特許が真正かつ最先の発明者を詐害する目的で取得されたことを理由として高等裁判所により取り消された、又は特許の付与が第9 条(1)項(a)号に定める理由で第9 条に基づき登録官により拒絶された場合、登録官は、本法の規定に従い真正の発明者又はその法定代理人又は譲受人が出願次第、当該発明の全部又は一部について特許を付与することができ、そのように付与された特許の日付はその特許が取り消されたと同じ日付、又は付与が拒絶された特許の場合は、その特許が付与されていたならその特許に付されていたであろう日付とする。例文帳に追加

(5) Articles 101, 104 to 105-2, 105-4 to 105-7 and 168(3) to 168(6) of this Act and Articles 719 and 724 (tort) of the Civil Code (Act No. 89 of 1896) shall apply mutatis mutandis to the exercise of the right to claim compensation under paragraph (1). Any person may, on payment of the prescribed fee, at any time within four months from the date of the advertisement of the acceptance of an application, give notice at the Department of Patents, Designs and Trade Marks of opposition to the grant of the patent on any of the following grounds, namely:- that the applicant obtained the invention from him, or from a person of whom he is the legal representative or assign; or that the invention has been claimed in any specification filed in Bangladesh which is or will be of prior date to the patent, the grant of which is opposed; or that the nature of the invention or the manner in which it is to be performed is not sufficiently or fairly described and ascertained in the specifications; or that the invention has been publicly used in any part of Bangladesh or has been made publicly known in any part of Bangladesh; or that the complete specification describes or claims an invention other than that described in the provisional specification, and that such other invention either forms the subject of an application made by the opponent for a patent which if granted would bear a date in the interval between the date of the application and the leaving of the complete specification, or has been made available to the public by publication in any document published in Bangladesh in that interval; but on no other ground.
