２　抑留資格認定官は、被拘束者が抑留対象者（軍隊等非構成員捕虜に限る。）に該当する旨の抑留資格認定をする場合においては、併せて、当該被拘束者を抑留する必要性についての判定をしなければならない。この場合において、当該被拘束者の抑留は、武力攻撃を排除するために必要な自衛隊の行動を円滑かつ効果的に実施するため特に必要と認めるときに限るものとし、抑留資格認定官は、あらかじめ、その判定について、防衛大臣の承認を得なければならない。例文帳に追加
