(3) The court may on request of defendant decide on giving warranty deposit over to the defendant as a compensation of pecuniary or non-pecuniary injury in finance caused directly by execution of preliminary measures and the plaintiff failed to submit the proposal to start proceedings within the time limit set by the court or the plaintiff was not successful on the merit of the case.
