(4) A designer, against whom the right to the design has been exercised under paragraph 3 shall be entitled to an appropriate remuneration from the employer. The contribution achievable by exploitation or other application of the design shall be decisive for the determining the amount of remuneration. The material share of the employer in the design developing as well as the scope and contents of designer’s tasks shall be taken into consideration. If the remuneration agreed or determined by a competent authority is clearly disproportionate to the benefit achieved by latter exploitation or other application of the design, the designer shall be entitled to an additional settlement. - 特許庁
