３　第一項の規定による支払の請求を受けて私的録音録画補償金が支払われた特定機器により同項の規定による支払の請求を受けて私的録音録画補償金が支払われた特定記録媒体に私的録音又は私的録画を行う者は、第三十条第二項の規定にかかわらず、当該私的録音又は私的録画を行うに当たり、私的録音録画補償金を支払うことを要しない。ただし、当該特定機器又は特定記録媒体が前項の規定により私的録音録画補償金の返還を受けたものであるときは、この限りでない。例文帳に追加

２　前項の規定により私的録音録画補償金を支払つた者は、指定管理団体に対し、その支払に係る特定機器又は特定記録媒体を専ら私的録音及び私的録画以外の用に供することを証明して、当該私的録音録画補償金の返還を請求することができる。例文帳に追加
