第八百四十一条　自己株式の処分の無効の訴えに係る請求を認容する判決が確定したときは、当該株式会社は、当該判決の確定時における当該自己株式に係る株主に対し、払込みを受けた金額又は給付を受けた財産の給付の時における価額に相当する金銭を支払わなければならない。この場合において、当該株式会社が株券発行会社であるときは、当該株式会社は、当該株主に対し、当該金銭の支払をするのと引換えに、当該自己株式に係る旧株券を返還することを請求することができる。例文帳に追加

Article 841 (1) When a judgment upholding a claim relating to an action seeking invalidation of a disposition of Treasury Shares becomes final and binding, the relevant Stock Company shall pay, to shareholders of such Treasury Shares as of the time such judgment became final and binding, monies equivalent to the amount of payment received from them or the value of the property delivered by them as of the time of the delivery.
