On the basis of the exclusive right of use, any of the holders shall be entitled to bring an action against any person who, in the course of trade: (a) uses the protected geographical indication or a denomination liable to create confusion with respect to products not originating in the defined geographical area; (b) uses the protected geographical indication with respect to products not included in the list of products, but similar to those and therefore takes unfair advantage of or infringes the repute of the protected geographical indication; (c) imitates or evokes in any manner whatsoever the protected geographical indication, even if the true origin of the product is indicated or if the protected name is translated or accompanied by various additions; (d) uses any false or misleading indication as to the provenance, origin, nature or essential characteristics of the product, no matter where it is indicated (e.g. on the packaging, advertising material or documents relating to the product concerned); (e) performs any other act liable to mislead the public as to the true origin of the product.例文帳に追加

Revocation of a patent in whole or in part may be obtained on petition to or on a counter claim in a suit for infringement before the High Court Division on all or any of the following grounds, namely:- that the invention has been the subject of a valid prior grant of a patent in Bangladesh; that the true and first inventor or his legal representative or assign was not the applicant or one of the applicants for the patent; that the patent was obtained in fraud of the rights of the person applying for the revocation or of any person under or through whom he claims; that the invention was not, at the date of the patent, a manner of new manufacture or improvement; that the invention does not involve any inventive step, having regard to what was known or used prior to the date of the patent; that the invention is of no utility; that the complete specification does not sufficiently and fairly describe and ascertain the nature of the invention and the manner in which the invention is to be performed; that the complete specification does not sufficiently and clearly ascertain the scope of the invention claimed; that the patent was obtained on a false suggestion or representation; that the primary or intended use or exercise of the invention is contrary to law; that the patentee has contravened, or has not complied with, the conditions contained in the patent; that the complete specification does not disclose the best method of performance of the invention known to the applicant for the patent at the time when the specification was left at the Department of Patents, Designs and Trade Marks.発音を聞く 例文帳に追加

特許の全部又は一部の取消しは、高等裁判所への請願書により、又は高等裁判所に係属している侵害訴訟中の反訴により、次の各号に掲げる事由のすべて又はいずれかを理由として得ることができる。すなわち、その発明はバングラデシュ国内において先願により有効に付与された特許の対象であること。真正かつ最先の発明者又はその法定代理人若しくは譲受人は当該特許出願人若しくは出願人の一人ではなかったこと。その特許は取消しを申請している者又は当該申請人がなす主張につき指示している者、若しくは当該申請人が代理している者の権利を詐害する目的で取得されたこと。その発明は特許された日において新規性を欠く製造方法又は改良であったこと。その発明は特許の日以前に知られていた又は使用されていたものに係るものであり、進歩性がないこと。その発明は有用性がないこと。完全な明細書は十分かつ正確に記載されておらず、発明の本質及び発明の実施方法が確認されないこと。完全な明細書から、請求する発明の範囲が十分かつ明瞭に確認されないこと。その特許は虚偽の示唆又は不実表示に基づいて取得されたこと。その発明の主な又は目的とする用途又は実施が法令に反すること。その特許権者が、当該特許に含まれる条件に違反し又は遵守していないこと。完全な明細書が、当該明細書が特許意匠商標庁に提出された当時に当該特許に係る出願人が知っていた、当該発明の最良の実施方法を開示していない。 - 特許庁

(1) A mark or part of a mark shall not be registered as a trade mark . (a) if the use of which is likely to deceive or cause confusion to the public or would be contrary to law; (b) if it contains or comprises any scandalous or offensive matter or would otherwise not be entitled to protection by any court of law; (c) if it contains a matter which in the opinion of the Registrar is or might be prejudicial to the interest or security of the nation; [Ins. Act A881] (d) if it is identical with or so nearly resembles a mark which is well-known in Malaysia for the same goods or services of another proprietor; [Ins. Act A1078] (e) if it is well-known and registered in Malaysia for goods or services not the same as to those in respect of which registration is applied for: Provided that the use of the mark in relation to those goods or services would indicate a connection between those goods or services and the proprietor of the well-known mark, and the interests of the proprietor of the well-known mark are likely to be damaged by such use; [Ins. Act A1078] (f) if it contains or consists of a geographical indication with respect to goods not originating in the territory indicated, if use of the indication in the mark for such goods in Malaysia is of such a nature as to mislead the public as to the true place of origin of the goods; or [Ins. Act A1078] (g) if it is a mark for wines which contains or consists of a geographical indication identifying wines, or is a mark for spirits which contains or consists of a geographical indication identifying spirits, not originating in the place indicated by the geographical indication in question.
