特に医薬発明の医薬用途について、SIPOは、1) 新しい化学物質の用途発明は、当該用途が、同様の構造又は組成を有する既知物質から予測できない場合、進歩性を有するとみなされ、2) 新規用途が、製品の構造、組成、分子量、既知の物理的・化学的特性、及び既存の用途から導かれ、又は予測することができるものの、当該物質の新しく発見された特性を利用し、予期せぬ技術的効果をもたらす場合、既知物質の用途発明は、進歩性を有するとみなされるとコメントしている。 - 特許庁
