In addition to the rights specified in Article 38 of this Law, the proprietor of a registered mark recognized as well-known in the Republic of Lithuania shall also be entitled to prevent third parties not having his consent from using, in the course of industrial or commercial activities, a sign which may be taken for a reproduction, an imitation or a translation, liable to create confusion, of a mark recognized as well-known, in relation to goods and/or services which are not similar to those under the well-known mark, provided that use of that mark in relation to those goods and/or services would indicate a connection between those goods and/or services and goods and/or services under a well-known mark and provided that the interests of the proprietor of the registered well-known mark are likely to be damaged by such use.例文帳に追加
