(3) 本条により，発明が，従業者とその使用者との間では，従業者に帰属する場合は， (a) 特許出願を遂行する目的で当該従業者若しくは同人の下で主張する者により若しくはその代理で，又は (b) 当該発明を実行若しくは実施する目的で何人かにより される行為は， 当該発明に関するひな形又は書類に対して，当該従業者とその使用者との間では，当該使用者が権原を有する如何なる著作権又は意匠権も侵害しないものと解される。 - 特許庁
