(7) A well-known mark which is registered is infringed or is deemed to be infringed by a person who, not being the registered proprietor of the well-known mark or a registered user thereof using by way of permitted use, (a) uses the mark in relation to goods or services identical with or similar to the goods or services for which the well-known mark has been registered; or (b) uses such a mark in relation to goods or services which not being identical with or similar to those in respect of which the well-known mark has been registered, by using of the mark in relation to those goods or services, would indicate a connection between those goods or services and the owner of the registered well-known mark and that the interests of the owner of the registered well-known mark are likely to be damaged by such use. 例文帳に追加
