第二十九条 出願者が発明又は実用新案の特許を外国で初めて出願した日から 12 カ月以内に、あるいは意匠特許を外国で初めて出願した日から 6 カ月以内に、中国で再び同様の主題について特許を出願する場合、当該外国と中国が締結した約定又は共に締結した国際条約に基づき、あるいは相互に優先権を認めることを原則とし、優先権を受けることができる。 - 特許庁
