４ １から３までの規定にかかわらず、次のことを行う場合は、「恒久的施設」に当たらないものとする。(a)企業に属する物品又は商品の保管、展示又は引渡しのためにのみ施設を使用すること。(b)企業に属する物品又は商品の在庫を保管、展示又は引渡しのためにのみ保有すること。 (c)企業に属する物品又は商品の在庫を他の企業による加工のためにのみ保有すること。(d)企業のために物品若しくは商品を購入し、又は情報を収集することのみを目的として、事業を行う一定の場所を保有すること。(e)企業のためにその他の準備的又は補助的な性格の活動を行うことのみを目的として、事業を行う一定の場所を保有すること。(f)(a)から(e)までに規定する活動を組み合わせた活動を行うことのみを目的として、事業を行う一定の場所を保有すること。ただし、当該一定の場所におけるこのような組合せによる活動の全体が準備的又は補助的な性格のものである場合に限る。 - 財務省

4. Notwithstanding the preceding provisions of this Article, the term “permanent establishment” shall be deemed not to include: a) the use of facilities solely for the purpose of storage, display or delivery of goods or merchandise belonging to the enterprise; b) the maintenance of a stock of goods or merchandise belonging to the enterprise solely for the purpose of storage, display or delivery; c) the maintenance of a stock of goods or merchandise belonging to the enterprise solely for the purpose of processing by another enterprise; d) the maintenance of a fixed place of business solely for the purpose of purchasing goods or merchandise or of collecting information, for the enterprise; e) the maintenance of a fixed place of business solely for the purpose of carrying on, for the enterprise, any other activity of a preparatory or auxiliary character; f) the maintenance of a fixed place of business solely for any combination of activities mentioned in subparagraphs a) to e), provided that the overall activity of the fixed place of business resulting from this combination is of a preparatory or auxiliary character. 例文帳に追加
