(4) Any interested party may file with Kazpatent a request for the cancellation of the registration of the trademark where the trademark has not been exploited in the five years following the date of registration thereof or in the five years preceding the filing date of the request. The request may relate to all or a part of goods specified in the certificate and shall be considered by the Board of Appeal within six months following the date of its receipt. The use of a trademark on goods for which it is registered and (or) on the packaging thereof shall be deemed to constitute exploitation of the trademark. The use of the trademark in advertising, in printed publications, on official headed paper, on signs or in connection with the display of goods at exhibitions that take place in the Republic of Kazakhstan may be considered as the exploitation thereof. The decision on whether or not to cancel the registration of the trademark for want of exploitation may be subject to the consideration of proof submitted by the owner to show that the failure to exploit the trademark is due to factors beyond his control.例文帳に追加

(2) if the mark has become misleading or contrary to law and order or morality since it was registered or became established. A trademark registration shall be invalidated if the trademark has not been used for the last five years and the proprietor is unable to give a proper reason for the non-use. Use of a trademark with the proprietor’s consent shall be considered equivalent to use by the proprietor. Invalidation of a registration may not be sought, however, if the trademark has been used after the expiry of a five-year period of non-use but before the request for invalidation. In such case any use of the trademark that occurred during the three months preceding the request for invalidation shall not be considered if the preparations for use commenced only after the proprietor became aware that a request for invalidation might be filed. (2) The first sentence of subsection (1) shall apply mutatis mutandis to the opponent and to the third party intervening under Section 59(2) as well as to the parties in proceedings regarding nullity of a patent or regarding a compulsory license (Sections 81, 85 and 85a) if the petitioner can credibly show a personal interest warranting protection.
