For the purposes of subsection (1), if an application is deemed to be abandoned for failure to pay a fee referred to in subsection 3(4) or (7), for the applicant to take the action that should have been taken in order to avoid the abandonment, the applicant must, before the expiry of the time prescribed by subsection (1), either (a) pay the applicable standard fee, or (b) file a small entity declaration in respect of the application in accordance with section 3.01 and pay the applicable small entity fee. 例文帳に追加

The prescribed annual fee in respect of each registration shall be payable before the 1st day of December in each year in respect of the following year, and in case it is not paid within one month from that date the Controller shall send to the registered trade mark agent at such agent's registered business address a notice in writing requiring such agent to pay the fee on or before a date to be mentioned in the notice, and in the case of failure to pay the fee within the time specified in the notice the Controller may cause the name of such agent to be erased from the Register of Trade Mark Agents.例文帳に追加

Where-- (a) an application for a standard patent has been deemed to be withdrawn and abandoned because a maintenance fee has not been paid within the period specified in section 33(2) and (3) of the Ordinance; and (b) the extended period specified in section 33(4) of the Ordinance has expired without the maintenance fee and prescribed additional fee having been paid, the Registrar shall, within 6 weeks after the expiration of the extended period, notify the applicant of the standard patent of the fact and draw his attention to the provisions of section 34 of the Ordinance. 例文帳に追加

An application deemed to be abandoned under this section shall be reinstated if the applicant (a) makes a request for reinstatement to the Commissioner within the prescribed period; (b) takes the action that should have been taken in order to avoid the abandonment; and (c) pays the prescribed fee before the expiration of the prescribed period. 例文帳に追加

The Controller may, on a request being made to him in the prescribed manner by any person, and on payment of the prescribed fee, cause a search to be made as regards any product, process or apparatus specified by the person making the request and amongst such categories of documents as are so specified, being categories of documents which for the time being stand prescribed for the purposes of this section and cause to be furnished the results of such search to the person. 例文帳に追加
