(4) Notwithstanding the provisions of paragraph (2), in the case prescribed in the preceding paragraph, appointment of a defense counsel under the provisions of Article 37-4 of the Code shall be made by a judge of the district court which has jurisdiction over the location of the penal institution set forth in the preceding paragraph or a judge of the summary court in the same location as said district court (including the same location as a branch of said district court).
