次の(a)及び(b)に該当する場合には、信託の受託者が行う事業は、一方の締約国の居住者が他方の締約国内にある恒久的施設を通じて当該他方の締約国内で行う事業とみなし、かつ、当該事業から取得される利得であって、当該一方の締約国の居住者の持分に対応するものは、当該恒久的施設に帰せられるものとする。(a)当該一方の締約国の居住者が、当該信託（租税に関し法人として取り扱われるものを除く。）の受託者が当該他方の締約国内において当該信託の受託者として行う事業から取得される利得に対する持分を直接に又は一若しくは二以上の信託を介して有する場合(b)当該事業の遂行に関して、当該信託の受託者が、第五条に定める原則に従い、当該他方の締約国内に恒久的施設を有する場合 - 財務省
