決済手段等に関する我が国の特徴、我が国においては、昭和４８年の全銀システム稼動以来、その利便性から金融機関の口座引落し、口座振込等が資金決済に広く利用されてきており、小切手を主要な決済手段としている欧米主要国と事情を異にしている。例えば、小切手による支払いに比し、金融機関の口座振込では、翌日に履行される振込の指図を破綻時に取り消すことができない等の特徴がある。また、口座引落しが主要な決済方法である我が国では、翌日以降の引落しに備えてあらかじめ決済資金を預金口座に預け入れておく場合が多い。預金の保護、金融機関の破綻処理手続に関する各国での法制の違いにより決済機能の安定性に差異が生じていることも考えられる。例えば、米国では預金債権に優先権が付与されているのに対し、我が国ではこうした措置はない。また、米国では金融機関の倒産法制は一般の倒産法制とは異なっており、倒産手続開始後も債権実行の取扱いが柔軟であるが、我が国では金融機関の倒産法制にこのような点で一般と異なる制度は用意されていない。以上の点を踏まえれば、特例措置終了後3における決済機能の安定確保のためには、決済機能のセーフティネットの状況を点検したうえ、他国の例にとらわれず、我が国の実態に即した方策が検討されて然るべきであり、したがって必要があればさらなる安定確保のための措置を講じることが適当である。例文帳に追加
