(1) When an accused charge with an offence under section 73 or section 74 of this Act in relation to a registered trademark pleads that the registration of the trademarks is invalid, the following procedures shall be followed- (a) if the Magistrate is satisfied that such defense is prima facie tenable, he shall not proceed with the charge but shall adjourn the proceeding for three months from the date on which the plea of the accused is recorded to enable the accused to file an application before the High Court Division under this Act, for the rectification of the Register on the ground that the registration is invalid. (b) if the accused proves to the Magistrate that he has made such application within the time so limited or such further time as the Magistrate may for sufficient cause allow, the further proceedings in the prosecution shall be stayed by the Magistrate till the disposal of such application for rectification and of the appeal, if any, there from. (c) if within a period of three months or within such extended time as my be allowed by the Magistrate, the accused fails to apply to the High Court Division for rectification of the Register, the Magistrate shall proceed with the case as if the registration were valid. 例文帳に追加

(1)本法第73条又は第74条に基づき、登録された商標に関する罪の被疑者が、当該商標の登録が無効であることを主張する場合、次に掲げる手順に従う。(a)治安判事が、かかる抗弁が一見して明らかに支持できることを確信した場合、同判事は起訴を行わず、被疑者が当該登録の無効を理由として登録簿の是正を求める申立書を本法に基づき高等裁判所に提出できるよう、被疑者の抗弁が記録された日から3月間訴追手続きを中断する。(b)被疑者がそのような期限内に、又は治安判事が十分な根拠に基づき認める追加期間内に当該申立てを行ったことを治安判事に証明すると、当該訴追手続きは、是正を求める当該申立て及び不服申立てがあればそれが処理されるまで、さらなる手続きは治安判事により中断される。(c)3月以内又は治安判事が認める延長期間内に、被告の登録簿の是正を求める高等裁判所への申立てを怠る場合、治安判事は当該登録が有効であるかのように当該事件を進行させる。 - 特許庁
