(6) The grant of a compulsory license to a patent shall become permissible only after the patent has been granted. The license may be granted subject to restrictions and made dependent upon conditions. The scope and duration of use shall be restricted to the purpose for which said license has been granted. The following is not recognized as an infringement of the exclusive right of the patent owner: (1) application of the means containing objects of industrial property protected by patents in the construction or during exploitation of transport facilities (sea-going, river, air, land and cosmic) of other countries under condition that said facilities temporarily or accidentally stay in the territory of the Kyrgyz Republic and are used for the needs of transport facility.
