第235条 施行日において係属している出願 235.1特許商標技術移転局に係属している特許出願は，当該出願がなされたときの法令に従って処理し及び特許を付与するものとし，その法令は，その法令の廃止に拘らず，この範囲で及びこの目的でのみ施行する。本法の施行日において係属している実用新案登録出願及び意匠登録出願は，当該出願がなされたときの法令に従って当該出願を処理することを出願人が選択した場合を除き，本法の規定に従って処理する。 - 特許庁
