しかしながら、土地の所有権とともに、当該土地の賃貸借契約における賃貸人たる地位を譲渡した場合について、賃貸人の義務は賃貸人が何人であるかによってその履行方法が特に異なるものではなく、また、土地所有権の移転があったときに新所有者にその義務の承継を認めることがむしろ賃借人にとって有利であることから、特段の事情のある場合を除き、新所有者が旧所有者の賃貸人としての権利義務を承継するには、賃借人の承諾を必要とせず、旧所有者と新所有者間の契約をもってこれをなすことができるものと解されている（最高裁昭和４６年４月２３日第二小法廷判決・民集２５巻３号388頁）。 - 経済産業省
