I take it that you are asking about the proposed amendment to the Insurance Business Act that has been passed to the current session for continued deliberation. I assume that you are questioning the appropriateness of a mutual aid business of a public interest corporation or the arrangement in which a mutual aid business of a given public interest corporation is to be supervised by the former competent authorities, with an implication that the FSA should be responsible for supervision. Well, the fact is that the respective authorities, having the experience of supervising public interest corporations for a long time, are well-versed with specifics of their operation. On the subject of this Act, I believe that I named several examples the other day, such as the Japan Medical Association, which has always been supervised by the Ministry of Health, Labour and Welfare since the Meiji era, including the years of supervision by its predecessor, the Health and Medical Bureau of the Ministry of Internal Affairs. While circumstances vary from authority to authority, they know very extensively about internal affairs of those corporations and have exercised thorough supervision and, in that sense, have a set of knowledge of their operation and other information accumulated in the course of the work of supervision in the past, which accordingly makes them presumably capable of delivering more fine-tuned supervision than the FSA would be. Since the most important thing is policyholder protection, we believe that, from such a perspective, having the former authorities supervise them is an appropriate way to go. It is also in comprehensive consideration of overall circumstances, including the fact that this exemption of the Act is a provisional step, that we find it appropriate to have the former authorities continue to supervise those corporations.  - 金融庁

As I repeatedly say, it is true that a higher capital adequacy figure may appear to imply security at a glance, but it can also lead to a credit crunch or oppressive debt collection practices, as we experienced 10 years ago. Back then, even healthy companies went under. As a Diet member of the ruling party in a ministerial post, I was faced firsthand with the confusion that prevailed in the Japanese economy at that time. It was in 1997 that the Hokkaido Takushoku Bank went under and Yamaichi Securities failed, soon ushering in what would be called the "Financial Diet Session." The Basel meeting is attended by 27 countries and, for all of them, a higher ratio figure, which does provide peace of mind and security, is at the same time not necessarily better in that light. As making a capital adequacy ratio too high can lead to a credit crunch and oppressive debt collection and hence a shrinking economy, we are hoping to maintain a good balance in view of all those factors. We are determined to make our point in the new requirement debate, keeping in mind where we stand as a country that actually experienced a financial crisis 10 years ago.  - 金融庁

As for the first question, the general rule of the financial bankruptcy processing system is actually fixed-amount protection, as I explained last week. Exceptions to this rule are cases in which there is a possibility of systemic risk arising, as you know. The examples I brought up the other day were the Incubator Bank of Japan and Ashikaga Bank: the Incubator Bank of Japan had about 400 billion yen in loans, and Ashikaga Bank had 4 trillion yen in loans. In particular, Ashikaga Bank is a financial institution designated by the Tochigi Prefectural Government, and its share in the regional community was extremely high, so as an exception, we convened the Financial Crisis Response Council for Ashikaga Bank. The Council is chaired by the Prime Minister, and its members include the Minister for Financial Services, the Chief Cabinet Secretary, FSA Commissioner, the Minister of Finance, and the Governor of the Bank of Japan. Exceptions are cases in which a systemic risk exists. In the present case, we determined that there is no such systemic risk. As I explained last week, the Bank only dealt in fixed-term deposits, meaning that there was no settlement system in its business model in the first place. We determined that the impact in the event of bankruptcy would not be broad because of the lack of transfers and the products being limited to fixed-term deposits. In that sense, we abided by the general rule and applied fixed-amount protection.  - 金融庁
