While my predecessor was in office, a law called the SME Financing Facilitation Act (Act concerning Temporary Measures to Facilitate Financing for SMEs, etc.) was established. In Japan, 99.7% of all companies are small and medium-sized enterprises, or SMEs, which employ 28 million people. Now, faced with growing economic globalization, especially since the Lehman crisis two years ago, SMEs have been suffering considerably from hardships. At the same time, though, SMEs have the advantage of being flexible and resilient and, from the viewpoint, the FSA considers SMEs to be extremely important. My hometown is the city of Kitakyushu, where Yahata Steel Works, initially a government-owned company, was founded 100 years ago, and served as the base for the creation of a large number of SMEs there. Fukuoka Prefecture, also home to factories of Toyota and Nissan, is the second-largest car-producing prefecture after Aichi, which explains the large number of modest-size companies and SMEs there.

Take the SME (small and medium-sized enterprises) Financing Facilitation Act, for example. We have extended its duration for one year. Whether or not Japanese SMEs can do well is, in an extreme sense, actually connected to questions like whether or not the Greek economy and fiscal performance are good or not. This suggests that, given the current globalization of the world economy, which has led to, notably, a high level of globalization in the financial sphere, money changes hands electronically from continent to continent in a split second.

Like Section 301 of the US Trade Act, the TBR is intended to promote the opening of foreign markets, but differs in some aspects. First, its scope is limited to trade practices for which international trade rules establish a right of action. Second, there is no rigid time frame between the initiation of an investigation and a determination, and the EU is bound by the findings of the dispute settlement procedures. The EU regime seems more consistent with the DSU. We can hardly say that this regime itself constitutes a “unilateral measureprohibited by the DSU. Because the philosophy of this scheme is somewhat similar to our “rule-based criteria,” it has some positive aspects. Nevertheless, since its scope is not limited to violations of the WTO Agreements, and the organizations to which dispute cases are referred are not limited to the WTO, it could violate the WTO Agreements if improperly applied. We believe that its practical application in the future needs to be monitored.

The other issue is to facilitate SMEs and regional companies. This has been addressed in the SME Financing Facilitation Act based on an unconventional financing approach. As I have been reappointed to Minister, I intend to work on the facilitation task in consideration of the social and public nature of the financial sector and the public interest it should fulfill. I am sure you are well aware that the Japanese economy is in an extremely tough situation at the moment. The first, second and third shots were taken by the Kan Cabinet in such circumstances, and especially given that SMEs in regional communities account for 99.7 percent of corporations in Japan, I intend to fulfill my duties properly by taking those factors into account.

As for the second question regarding what I currently think about such consumer finance companies, generally speaking, my understanding is that although the current business climate for consumer finance companies is harsh, there is still much healthy demand for funds in the consumer finance market. According to one theory I have heard, there are about 15 million users of consumer finance. As there are, of course, sound borrowers in that sense, some financial institutions in other industries such as banks are making aggressive efforts in the field of consumer finance, and in banks and other financial institutions in foreign countries, consumer finance has become a significant business segment. Bearing this in mind, Japan's consumer finance market is a promising market, and moneylenders are expected to take on a significant role in this market. Accordingly, the FSA hopes that moneylenders will become a significant player in the consumer finance market through their own management efforts, according to the objectives of the amended Money Lending Act.

I do not think there are any inconsistencies in the logic. If my memory serves me correctly, the “pay-offscheme was established around 1971—back then, many banks went bankrupt. In my personal experience, while I served as Minister in the Second Hashimoto Cabinet from 1997 to 1998, Hokkaido Takushoku Bank went bankrupt, Yamaichi Securities collapsed, and dozens of financial institutions failed in Japan at the time. As depositors were extremely anxious back then due to the collapse of many financial institutions, the government decided not to implement the “pay-offscheme between 1996 and March 2002 despite the existence of legal provisions. Today, financial conditions have somewhat settled since the collapse of Ashikaga Bank, and Japan’s financial climate is calm on the whole, notwithstanding the Lehman Brothers shockwave on a global scale. At the end of the day, I believe depositors need to choose banks based on the principle of self-responsibility. At the same time, there is one thing I would like to emphasize especially to top management executives—the borrowers. They should feel very sorry to depositors if thepay-offscheme is implemented. Individuals with 10 million yen in deposits plus interest who are entitled to receive provisional payback under the Deposit Insurance Act will ultimately have the amount reduced to a certain extent, thereby causing substantial trouble to depositors. In that sense, all top management executives and others involved in the management of Japanese financial institutions should re-acknowledge the gravity of their management responsibility for financial business.
