Notwithstanding the provisions of paragraph 2, interest arising in a Contracting State shall be taxable only in the other Contracting State if: (a) the interest is beneficially owned by that other Contracting State, a political subdivision or local authority thereof, or the central bank of that other Contracting State or any institution wholly owned by that other Contracting State; (b) the interest is beneficially owned by a resident of that other Contracting State with respect to debt-claims guaranteed, insured or indirectly financed by the Government of that other Contracting State, a political subdivision or local authority thereof, or the central bank of that other Contracting State or any institution wholly owned by that other Contracting State; (c) the interest is beneficially owned by a resident of that other Contracting State that is either: (i) a bank (including an investment bank); (ii) an insurance company; (iii) a registered securities dealer; or (iv) any other enterprise, provided that in the three taxable years preceding the taxable year in which the interest is paid, the enterprise derives more than 50 percent of its liabilities from the issuance of bonds in the financial markets or from taking deposits at interest, and more than 50percent of the assets of the enterprise consist of debt-claims against persons that do not have with the resident a relationship described in subparagraph (a) or (b) of paragraph 1 of Article 9; (d) the interest is beneficially owned by a pension fund that is a resident of that other Contracting State, provided that such interest is not derived from the carrying on of a business, directly or indirectly, by such pension fund; or (e) the interest is beneficially owned by a resident of that other Contracting State and paid with respect to indebtedness arising as a part of the sale on credit by a resident of that other Contracting State of equipment or merchandise. 例文帳に追加

(3) Subject to paragraphs (a) and (b) of section 37, paragraphs (a) to (c) of subsection (1) of section 40 and this Part, the registration of a person as registered proprietor of a certification trade mark in respect of any goods shall, if valid, give to that person the exclusive right to the use of the trade mark in relation to those goods, and without prejudice to the generality of the foregoing words, that right shall be deemed to be infringed by any person who, not being the registered proprietor of the trade mark or a person authorised by him under the rules in that behalf to use it in accordance therewith, uses a mark identical with it or so nearly resembling it as is likely to deceive or cause confusion, in the course of trade, in relation to any goods in respect of which it is registered and in such manner as to render the use of the mark likely to be taken either . The ban was fully lifted in December 2007, with the sales of all insurance products approved as a result and, now that roughly three years have passed, the steps for prevention of harmful practices are slated to be changed as necessary on the basis of monitoring results and other information from the perspective of the protection and convenience of insurance policyholders, etc. However, I do not feel it appropriate to make a definite statement about any future orientation now. From what I heard, however, over-the-counter sales make up 1 percent of non-life insurance sales and approximately 6 percent of life insurance sales, which are the figures that I believe have been reported to me. Judging from those, it seems to me that the firewall or information on financing deals is protected fairly strictly. I recall the debate that took place in the past about the possible highly negative impact of the insurance sales by banks on the livelihood of sales agents marketing life insurance products but some regional banks are actually not engaged in life insurance sales. In the meantime, I hear that the three mega-banks are selling life insurance, but my guess is that it rather reflects their effort to have a full line of products, so to speak. The possibility of the insurance sales by banks posing a real threat to the life insurance industry, particularly the livelihood of life insurance sales agents, was a subject of a heated debate in the LDP as well. It turns out that more liberalization does help add more convenience for the people, as the results show: the over-the-counter sales by banks make up 6 percent of life insurance sales and 1 percent in non-life insurance sales. Let me also point out that it is extremely important to protect life insurance policyholders and that the greater the convenience for prospective policyholders, the more accessible life insurance becomes. (2) The provisions of Article 97(3) of this Act and the provisions of Part VII, Chapter II, Section 2 (excluding Article 847(2), Article 849(2) and (5) and Article 851) (Action for Pursuing the Liability, etc. of a Stock Company) of the Companies Act shall apply mutatis mutandis to an action seeking liability filed against the director of a Specific Purpose Company under the provisions of Article 117 and to an action seeking liability filed against the director of a Specific Purpose Company under the provisions of the preceding Article and Article 464 of the Companies Act as applied mutatis mutandis pursuant to the preceding paragraph.
