I am paying very close attention to the Act, which covers a period of two years including two year ends and two fiscal year ends; I believe this is groundbreaking legislation in Japan. The perspectives of megabanks seems to have somewhat changed, as I have been told by a staff member at one of the local financial bureaus that a megabank started participating in conventions of shinkin banks and credit unions since the establishment of the Act for the first time ever. It may be common knowledge, but 99.7% of companies in Japan are SMEs, and 42 million people work for SMEs. SMEs are rather agile, flexible and extremely precious. As I may have mentioned previously, in my hometown Kitakyushu City, which is a city dominated by SMEs, I have been told by businesspeople that their companies have actually managed to survive due to the establishment of the Act. The ban was fully lifted in December 2007, with the sales of all insurance products approved as a result and, now that roughly three years have passed, the steps for prevention of harmful practices are slated to be changed as necessary on the basis of monitoring results and other information from the perspective of the protection and convenience of insurance policyholders, etc. However, I do not feel it appropriate to make a definite statement about any future orientation now. From what I heard, however, over-the-counter sales make up 1 percent of non-life insurance sales and approximately 6 percent of life insurance sales, which are the figures that I believe have been reported to me. Judging from those, it seems to me that the firewall or information on financing deals is protected fairly strictly. I recall the debate that took place in the past about the possible highly negative impact of the insurance sales by banks on the livelihood of sales agents marketing life insurance products but some regional banks are actually not engaged in life insurance sales. In the meantime, I hear that the three mega-banks are selling life insurance, but my guess is that it rather reflects their effort to have a full line of products, so to speak. The possibility of the insurance sales by banks posing a real threat to the life insurance industry, particularly the livelihood of life insurance sales agents, was a subject of a heated debate in the LDP as well. It turns out that more liberalization does help add more convenience for the people, as the results show: the over-the-counter sales by banks make up 6 percent of life insurance sales and 1 percent in non-life insurance sales. Let me also point out that it is extremely important to protect life insurance policyholders and that the greater the convenience for prospective policyholders, the more accessible life insurance becomes. I cannot give any definite word at this point in time – if I may be a little daring, however, I would say on the issue of the scheduled review after three years that the statistics look acceptable to me, but that is just my personal opinion.  - 金融庁

On the basis of the exclusive right of use, any of the holders shall be entitled to bring an action against any person who, in the course of trade: (a) uses the protected geographical indication or a denomination liable to create confusion with respect to products not originating in the defined geographical area; (b) uses the protected geographical indication with respect to products not included in the list of products, but similar to those and therefore takes unfair advantage of or infringes the repute of the protected geographical indication; (c) imitates or evokes in any manner whatsoever the protected geographical indication, even if the true origin of the product is indicated or if the protected name is translated or accompanied by various additions; (d) uses any false or misleading indication as to the provenance, origin, nature or essential characteristics of the product, no matter where it is indicated (e.g. on the packaging, advertising material or documents relating to the product concerned); (e) performs any other act liable to mislead the public as to the true origin of the product. - 特許庁

A warrant issued under this section may authorize persons, including the registered proprietor or his or her designated representative, to accompany and assist any member of the Garda Siochana in executing the warrant or in collating any inventory or other evidence. A person who-- obstructs or interferes with a person acting under the authority of a warrant issued under this section, is found in, on or at the premises or place specified in the warrant by a member of the Garda Siochana acting as aforesaid and who fails or refuses to give the member his or her name and address when required to do so or gives a name or address that is false or misleading, obstructs the exercise of an authority conferred by a warrant under this section, or fails or refuses to give information to a member of the Garda Siochana when requested to do so under this section, shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding .1,905 (￡1,500), or to imprisonment for a term not exceeding 12 months, or both. - 特許庁
