As the global recession has continued since the Lehman shock, which occurred three years ago, Mr. Kamei, my predecessor as the Minister for Financial Services, put into force the SME Financing Facilitation Act (Act concerning Temporary Measures to Facilitate Financing for SMEs, etc.). After holding hearings with four associations of small and medium-size enterprises (SMEs) and regional financial institutions in various places across Japan, including Tokyo, Osaka, Nagoya, Fukuoka, Kitakyushu and Sendai, I concluded that it would be the right decision to extend this act for one year as the head of the administrative agency in charge of financial affairs. We will submit a relevant bill to the next ordinary session of the Diet and do all we can to have it enacted at an early date.  - 金融庁

I have been informed that all of Takefuji's loans are personal loans, of which approximately 10% are for individuals running their own businesses. I might also add that even after corporate rehabilitation procedures commence, borrowers should continue making repayments on agreed-on terms. When the SME Financing Facilitation Act was established just after the Lehman shock two years ago, it was given the duration of roughly one year. With Toyota suffering a 40 percent drop in car sales two years ago – my home prefecture, Fukuoka, Kyushu, produces more than one million cars and is the second largest car-producing prefecture after Aichi – one after another of the car makers, including Toyota and Nissan, fired temporary workers. It was under those circumstances that we launched this Act, but, at the same time, it is also true that in the context of a capitalist society and a free society, there is a concern that the Act might result in financial discipline deteriorating in the form of moral hazard on the part of borrowers. As we have done every year, we selected cases from the inspection results reported from July of last year to June of this year and published them in the form of the latest Compilation of Problem Cases Raised in Financial Inspections for the 2009 program year, as you've just pointed out, which I expect each financial institution to refer to when formulating its future internal control system. I know an SME owner in my hometown who employs about 100 people, about 50 of them being permanent employees and the rest working on a non-permanent basis, and who says that he is able to barely survive thanks to the establishment of the SME Financing Facilitation Act but also speaks out, "Mr. Jimi, we are now desperate for more work." He also goes on to say that "I personally feel that I could close down the business, but I am hanging on, struggling with all my might - because every one of my 100 workers has a family."  - 金融庁

I might add my personal comment, though – the action plan for the New Growth Strategy, which we developed recently, advocates growth of financial institutions themselves and it is therefore quite critical for various financial segments, including securities, to have as many trading activities as possible, which makes any potential impact on them from taxation quite significant. Even a case where a financial institution does not literally meet the requirement of a check item should not be regarded as inappropriate if the arrangements and procedures put in place by the institution are reasonable from the viewpoint of securing of the soundness and appropriateness of its business and are thus deemed as effectively meeting the requirement or as sufficient in light of the institution's scale and nature.
