It has been argued that personal guarantees hinder restarts and restructuring. At the same time, however, guarantees reduce agency costs and are used as a signal that debtors will repay their debts properly under the terms of imperfect agreements, and the system itself is recognized as playing a certain role. Guarantees cannot therefore be regarded in an entirely negative light. Nevertheless, as we have seen above, (1) the chances of obtaining an unguaranteed loan are improved by building relations with financial institutions, and (2) the development of financial instruments in recent years has also led to the emergence of borrowing instruments40) that do not require security or third-party guarantees, such as quick loans, giving enterprises a choice of options regarding personal guarantees best suited to their circumstances.

This is a rather difficult task, and as I have said over and over again, although it might be easy to restore the postal businesses, whose foundations were shaken by Mr. Koizumi (former Prime Minister), to their former status, that is not what we are going to do. As we are undertaking a grand project of considering how to make use of Japan Post, which we may say is the biggest in the world, for the benefit of the whole of Japan and the entire world, this is a rather challenging task. We are now seeking public opinions and advice from far and wide. We are undertaking this project in the hope of achieving it together with the people, as I have been saying. If you ask me whether our study is proceeding smoothly, I can only say that a plan like this does not take a clear shape until the very last moment. In any case, everyone is doing his part in his own position, so we will be able to set forth a direction by around the end of this month.

All those things considered, the consultancy function of local small and medium-sized construction businesses, which in the Tohoku region make up 25 percent of the industry, looms significant. In the business of housing construction, a very high gross margin can be achieved from renovation or construction projects. It is roughly 25 percent to 30 percent. However, the gross margin from building a private condo, for example, is very small, because any business that orders a condo construction project is, of course, a professional entity. The Ministry of Land, Infrastructure, Transport and Tourism (MLIT) is also currently encouraging the industry to venture more aggressively into the housing renovation and construction business. Considering that the construction industry is something that remains necessary for all time, even in times of fewer public works projects, and the MLIT and the banking industry are also aware of their potential consultancy function in that area, I also feel that it will probably be necessary for businesses to, among other things, shift their management policy in that direction in an attempt to reform their business structure in the coming year. I think that it is necessary to try coming up with various ideas in that regard. To give them time to make such an attempt, we found it appropriate to allow one more year, which was one of the reasons behind the one-year period of extension.

To carry out the reform, I believe that it is an urgent task to enact the postal reform bills quickly. On Tuesday, August 30, an agreement was reached between Prime Minister Noda, who is the new leader of the Democratic Party of Japan, and Mr. Kamei, the leader of the People's New Party, that in light of the severe situation of the postal businesses, efforts should be made to secure an agreement on those bills - the People's New Party and the Democratic Party have been working together on the bills for as long as four years - as the top priority matter through inter-party revision consultations and enact them in the next extraordinary session of the Diet. Cabinet ministers will work together toward quick enactment of the postal reform bills under the Prime Minister's leadership.

In many consumer finance companies, there continue to be people with a healthy demand for funds, and in financial institutions in other industries such as banks, aggressive efforts are being made in the consumer finance sector. Leading banks are entering the consumer finance sector and, in major global financial institutions and banks, this sector has become a significant business segment. Basically, the consumer finance market is an extremely promising market, so it is hoped that consumer finance companies will play a significant role in that market.

The idea of using postal savings funds for that purpose is indeed on our horizons. That said, in view of a free economy, I do find it very positive that shinkin banks, credit associations or banks have embarked on such an area of business – that there is a trend of engaging in activities of this sort actually developing in the marketplace. Having just heard of a viewpoint that the use of Japan Post Bank money is quite difficult in reality, I do think that the need that exists will have to be addressed, taking into account various circumstances, including those which I have just talked about.

More than a decade ago in Japan, I served as minister in the days of Ryutaro Hashimoto’s Cabinet. During my term of office, we faced a financial crisis with the collapse of Hokkaido Takushoku Bank and Yamaichi Securities. Banks need to have sufficient capital, and be stable and robust. On the other hand, actions to hastily fulfill this need will lead to credit crunch and credit withdrawal, which undermine the soundness of banks and cause economic turmoil in regional communities. I reported this to you after meeting Federal Reserve Board (FRB) Chairman Ben Bernanke in August. In my constituency, Kitakyushu, such credit crunch at the time caused the bankruptcy of two Sogo Department Stores in Kitakyushu City, and I had an extremely tough time as a member of the Diet representing the local community.

Regarding my duties as the Minister for Financial Services, the basic missions of the Financial Services Agency (FSA) are to ensure the stability of the financial system, protect users, improve the convenience of users, and establish a fair and transparent market. However, the facilitation of financing, regarding which I received an instruction from the Prime Minister today, is also important. As the global recession has continued since the Lehman shock, which occurred three years ago, Mr. Kamei, my predecessor as the Minister for Financial Services, put into force the SME Financing Facilitation Act (Act concerning Temporary Measures to Facilitate Financing for SMEs, etc.). After holding hearings with four associations of small and medium-size enterprises (SMEs) and regional financial institutions in various places across Japan, including Tokyo, Osaka, Nagoya, Fukuoka, Kitakyushu and Sendai, I concluded that it would be the right decision to extend this act for one year as the head of the administrative agency in charge of financial affairs. We will submit a relevant bill to the next ordinary session of the Diet and do all we can to have it enacted at an early date.
I would like to refrain from commenting directly on the activities of foreign law enforcement authorities. This is a point that the FSA has been aware of since last autumn and that has been pointed out in the first report of Minister Watanabe's Financial Markets Strategy Team, but behind the fact that the subprime mortgage problem has led to a criminal case is the fact that this problem is related to a business model known as "originate-to-distribute" (which creates credit on the premise that risks will be transferred from the originator to other parties), based on the financial engineering technique of securitization.

Nor do I believe that creating huge banks and insurance companies is necessary for the Japanese economy or for the people's lives. As I have been saying, we will reform the postal businesses because we believe that we must not allow the privatization carried out by the former Prime Minister Junichiro Koizumi to significantly undermine the mission performed since the Meiji Era for the sake of the country and local communities by the postal businesses, which used to be essential to the people's lives. Therefore, as I have said over and over again, our basic stance is that the postal businesses should start over as an organization capable of fulfilling the social functions that Japan Post has assumed since the Meiji Era, rather than pursuing acting as a pure financial institution. Our cabinet resolution (on October 20) has also set forth such a direction.
In Japan as well, then-Deputy Governor Yutaka Yamaguchi of the Bank of Japan pointed out regarding the current financial system wherein globalization and diffusion of IT are progressing, that the depth and ample liquidity of markets created by technological innovation and globalization in normal times could be immediately lost in times of a financial crisis accompanied by enormous stress, and there is an inherent risk that it would further amplify the crisis. He also added, “Under such circumstances, we should not suppress, by regulation, the development of technology and innovation in the market. Rather, we should strive to provide a supportive market infrastructure, including regulation and supervision, market practices, disclosure, and accounting methods, in a broad context and to make it more robust. The systematic improvement of market infrastructure will contribute to reducing the risk of financial crises, which is the most serious uncertainty.” 13例文帳に追加

As you know, DPJ President and Prime Minister Kan and (PNP) Chief Kamei had a leader meeting the day following the day Prime Minister Kan assumed office, I believe, during which a decision to form a coalition was made. As I happened to be the Secretary General back then, I was also present at this meeting to witness, as I have explained, President Kan and Chief Kamei reach an agreement on creating an alternative to the Ministerial Committee on Basic Policies, which had been set up for the previous three-party coalition to coordinate their policies. This has not been done because everyone got a little busy in preparation for the election, as I have just talked about. Another point is that members of the PNP, being one of the parties in the coalition, have naturally raised voices requesting strongly that views of the party be reflected in the coalition. It is therefore not so much about the ceiling debate, although there are, of course, voices raised on the subject of ceilings, as it is simply natural that a coalition government should need to coordinate policies. That is what I reminded Prime Minister Kan of today, and he responded by saying that it is a matter of fact and telling Policy Research Committee Chair and Minister of State Gemba to create a proper system for it. While I did have a talk with Mr. Gemba later on, this is an issue between parties and I am sure that it will accordingly be handled properly, as it should be, by the Chief, or Secretary General or Policy Research Committee Chair of our party.

In any case, as I have said over and over again, loan repayment in the disaster areas is a matter that cannot be dealt with within the scope of private financial institutions' activities alone. The day before yesterday, the House of Councillors unanimously passed the bill to amend the Act on Special Measures for Strengthening Financial Functions. I am grateful for the passage, as this will strengthen the financial functions in a comprehensive manner and reassure depositors in the disaster areas. Although the Diet has undergone an upheaval, as the minister in charge, I am very grateful to the political parties and parliamentary groups in both the House of Representatives and the House of Councillors for passing this bill based on common sense for the sake of people in the disaster areas. Strengthening the financial functions and reassuring depositors is important in times like these.

As you may already be aware, the impact from Greece is spreading across the world, not surprisingly. The primary concern is how the European Union (EU) itself would respond to this, and indeed, the EU is currently working hard on it, but ultimately, it will inevitably affect Japan as well. As to whether or not Japan itself has any means to control such impact, regrettably, it has no means to completely shield itself from it, especially in regard to financial markets. Even today, the Nikkei average plummeted by four hundred yen or more. Given that there has been such an impact, I believe, after all, that Japan must determine ways to strengthen itself from within, and ways to implement efforts that are unique and feasible to Japan, while experiencing such global ups and downs, both big and small.

One of them, which constitutes a major pillar of the reform, is the adoption of a macro-prudential policy, which seeks to strengthen the stability of the financial system as a whole with systemic risks in mind. On this point, Japan is in deep agreement with the United States, and Japan will need to study this matter in relation to how its own financial regulation and supervision should be conducted while carefully watching global developments from the viewpoint of realizing internationally consistent regulation and supervision. We should also strive to ensure appropriate supervision while strengthening our cooperation with foreign supervisory authorities as well as with the Bank of Japan, although there is already considerable cooperation

The judgment for the Mark Lester case states that "A person who selected to engage in an occupation such as an actor may be considered as having given comprehensive consent to the disclosure of his/her name and image to public. Therefore, so far as such person is concerned, there would be much less need for protection of the aforementioned personal moral rights. Further, considering that gaining popularity is the essence of such an occupation, a person like an actor normally wishes to have his/her name and images widely disclosed to public and thus he/she will not, unlike ordinary people, generally suffer mental damages due to the disclosure of his/her name and images. Therefore, the actor etc. is entitled to claim for compensation of damages on the ground of his/her mental suffering due to the unauthorized utilization of his/her name or images only where the method, manner or purpose of utilization is detrimental to his/her occupational reputation, fame, and public image or where any other special circumstances exist (for example, where the actor sticks to the belief that his name or images should never utilized for product advertisements)." This case held that the portrait rights and privacy rights of celebrities are limited to a considerable extent.
In the City Bus case the Tokyo District Court July 25, 2001 ruled that "whether or not Article 46, Item 4 is applicable should depend on whether the copyrighted artistic work is reproduced "exclusively" for marketing or the reproduced work is actually sold to third parties. In order to determine this, circumstances such as the formalities, the contents, the manner and method of use of the publication should be objectively examined." In light of these criteria, the judgment further held that "the Defendant's book is a publication edited for the purpose of explaining to children various types of vehicles running on the street by using their photographs. It provides an explanation on the exterior and role of each of the 24 types of vehicles in total. This book is edited from the viewpoint of pre-school education in that children are expected to develop their observation skills as well as curiosity, which will in the future become a basis for learning. The method of inserting the picture in the cover page and page 14 is not unnatural in light of the purpose of this publication. Considering that the viewers of this book will have the impression that the photograph of the bus is placed on various pages as an the example of the diverse vehicles referred to in the body text of the book, the act of selling a book which includes a photograph of the bus with the plaintiff's work shall not fall under the relevant criteria as previously descirbed; the copyrighted artistic work is reproduced "exclusively" for marketing or such reproduced work is actually sold to third parties. Therefore, such act does not fulfill the conditions required under Article 46, Item 4 of the Copyright Law.

With less than one month left until the expiry of the current Diet session, the mass media have expressed doubt over the fate of the bill. The postal reform bill is intended to ensure that postal services will continue to be universally provided comprehensively by post offices from the standpoint of users and the general public by resolving various problems arising from the postal privatization. The important thing is this. I recently visited Ishinomaki in Sendai City, and as reported by national newspapers over the past few years, I talked with Japan Post employees there and was told that the division into five companies created a difficult situation after the earthquake. For example, at the Ishinomaki post office, the chain of command was split between the postmaster and the branch manager of Japan Post Service Co., as I related to you previously.
One lesson provided by the current global financial crisis that is gradually becoming a consensus is that financial business that generates added value by creating several layers of securities from the underlying assets, which may be called financial engineering for the sake of financial business, is not necessarily desirable. Although products thus created may play a significant role in some cases, it is not necessarily desirable for the general public. In short, the recognition is spreading around the world that the role that the financial sector is supposed to play is to properly support the real economy, ensure optimal allocation of resources from the perspective of the entire national economy and facilitate and strengthen this process. In this sense, I hope that the Japanese financial industry will make efforts to provide high-quality services that properly meet the needs of households and companies.

In response G7 Finance Ministers agreed that we would not expect debt payments from affected countries that request it until the World Bank and IMF have completed a full needs assessment of their reconstruction and financing requirements, recognizing that some countries may be unable to make debt payments. We will work, within the Paris Club, with other creditors to achieve a consensus for this approach; depending on the conclusions of the needs assessments, we also stand ready to consider all appropriate measures for further assistance; the IMF, World Bank, Asian Development Bank and other multilateral institutions should make the strongest efforts possible to provide financial assistance, including through emergency post-disaster facilities; and we support urgent consideration by relevant fora of the international community to put in place an effective tsunami early warning system in the Indian Ocean, and the infrastructure necessary to make it effective.
