Specific tasks include, first, how best to deal with the continuing turmoil in the global financial markets and, secondly, how to ensure that Japan’s financial sector exercises its financial intermediary role properly amid the signs of a domestic economic downturn and the increasingly severe business conditions for small- and medium-size enterprises (SMEs). A third major task is to strengthen the international competitiveness of Japan’s financial and capital markets. I am sure that these will be among major themes we will deal with under the new minister.
In relation to the G7, while G7-related matters are basically under the jurisdiction of the Ministry of Finance, Minister of Finance Nakagawa doubles as the Minister for Financial Services. If foreign people who do not know of the circumstances look at that kind of video image, some of them may be worried about Japan’s financial authorities. You said earlier you had been told that he made appropriate statements regarding Japan’s recognition of the current situation. Am I correct in understanding that you do not think the international credibility of Japan’s financial authorities has been undermined by that incident?
I have a question relating to the capital adequacy requirement for banks. At your press conferences and on other occasions, including at a press conference that was held the other day, you said that it was not necessary to apply strict regulations to financial institutions that do not operate internationally but concentrate on domestic operations and that a (temporary) drop below the required capital level would not become an issue to fuss about. While the minimum capital adequacy ratio is set at 8% under the Basel accord, Japan applies a minimum ratio of 4% to financial institutions concentrating on domestic operations instead of strictly applying the 8% requirement to them. Am I correct in understanding that what you meant was that such financial institutions' capital adequacy ratio may drop even below 4%?
Katsumi KUROITA, based on an investigation conducted by Tokyo Imperial University's naval hydrographic department into the tidal currents on May 2, 1185, proved that the westward tidal current in the Kanmon straits started flowing eastward at 8:30 in the morning, reaching a speed of eight knots by around 11 AM, and returned to flowing westward at around 3 in the afternoon; asserting that the times given in the "Gyokuyo" for when the battle was fought (from noon to 4 PM) were correct and thus that the battle took place in the afternoon, he further stated that as long as the current was flowing east the Taira clan had the advantage, but after it switched back to flowing west, there was a reversal of fortunes and the Minamoto clan gained the upper hand.

I assume you are asking what FSA’s economic policies would consist of. The FSA will continue to closely monitor the developments in markets including foreign exchange and stock markets, and respond properly according to the economic and financial climate from the viewpoint of sufficiently demonstrating financial intermediation functions. In fact, at today’s informal gathering with Cabinet ministers, financial measures for SMEs were brought up by the Minister of State for Economic and Fiscal Policy, if I am not mistaken. As you may already know, the Act concerning Temporary Measures to Facilitate Financing for SMEs, etc. was established based on the agreement among the three ruling parties when Shizuka Kamei served as Minister for Financial Services. I am paying very close attention to the Act, which covers a period of two years including two year ends and two fiscal year ends; I believe this is groundbreaking legislation in Japan. The perspectives of megabanks seems to have somewhat changed, as I have been told by a staff member at one of the local financial bureaus that a megabank started participating in conventions of shinkin banks and credit unions since the establishment of the Act for the first time ever. It may be common knowledge, but 99.7% of companies in Japan are SMEs, and 42 million people work for SMEs. SMEs are rather agile, flexible and extremely precious. As I may have mentioned previously, in my hometown Kitakyushu City, which is a city dominated by SMEs, I have been told by businesspeople that their companies have actually managed to survive due to the establishment of the Act. Then again, I have also heard cries from them that what they want now is work, so we intend to execute appropriate policies in a timely manner by taking these matters into consideration as well.
This would be established on the basis of investment from SME Support, Japan, prefectural governments and financial institutions under the plan. I think that the LDP's plan, with which I am not very familiar, is similar in basic concept to the DPJ's plan in that it is a scheme that concerns the double loan problem and aims to revive SMEs. The difference between these two plans is the scope of support. If the plans are presented, basically, they will be deliberated in the Diet, or will be discussed by the executive team and policymakers of each party. As both plans call for such a scheme, my general impression is that there is room for negotiation.
As for your question about the prospect for the procedure to begin after the weekend, the fact is that it was this morning that the Incubator Bank of Japan held a Board of Directors meeting, made the decision that has been described, and filed a report to the FSA. I have been informed that the bank's staff reported to work this morning and there has been no significant confusion thus far. As Japan boasts the world's most developed financial institution failure legislation, I am hoping that the operation will proceed in a tranquil fashion and that is what I mean by my request to act calmly. Just before I came here, I received a report from the field, indicating that their operation is underway in a highly tranquil fashion.

Always keeping wide awake at committee meetings is a challenge of sorts, so I am having a hard time. However, my tasks are simply an extension of what I was previously doing. In addition, as the FSA Commissioner is responsible for overseeing financial administration, I have to do my part as the Minister of Financial Services only when an incident of really great importance has occurred or when it is necessary to pass legislation in the Diet. Mr. Sato, the FSA Commissioner, is conducting all the administrative work on his responsibility, so my workload is just slightly more than that of two ministerial posts combined.
That is because if the use of US GAAP is to be prohibited, it will become necessary to automatically shift to IFRS, and that would be contradictory to our stance that we should spend a substantial amount of time on discussing this matter. In this respect, there is a significant misunderstanding in the industrial sector. As I am going to convene an expanded Business Accounting Council by the end of June to conduct debate on IFRS, I summed up my opinion in this report, expressing my intention to remove the termination date of the treatment to allow the use of US GAAP for disclosure purposes, namely up to the business years ending on or before March 31, 2016, so that the use of US GAAP can continue.

By way of a summing-up, I express my deep gratitude for the generous assistance that all of you gave me. What left me with a particular impression was our inevitable choice to use – for the first time after the Second World War – the payoff program in relation to the Incubator Bank of Japan, as you know. Despite the fact that it was the first such case after the Second World War, the depositors responded in a very calm fashion. The payoff program is up and running as we speak, and I am grateful that we have been able to implement it in a tranquil fashion. To tell the truth, it was personally a heart-rending experience as I recognize the tremendous inconvenience being caused to those with more than 10 million yen plus its interest in deposit. However, the Deposit Insurance Corporation is currently dealing with the former management to properly look into its criminal and civil responsibilities and other matters. While it is still an ongoing case, this payoff implementation left me with a particularly immense impression among what happened in my three months in office of the Minister for Financial Services.
While I am not an expert in finance, I am aware that the global economy has drastically changed in some ways since the Lehman Brothers shockwave, and that each country truly has its own problems. Over the past three decades, especially since the collapse of the Soviet Union, the United States has been extremely powerful in economic, political and military terms as the single most dominant country, and my understanding is that so-called financial capital has played a central role. I believe the Lehman Brothers shockwave was a major turning point for American-style finance-oriented capitalism, leaving it no alternative but to undergo transformation. As you are well aware, the financial capital had the political backup of former U.S. Republican President George W. Bush. Nevertheless, even the United States had its President changed to Barack Obama. If you take a look around the world, events like the Greek shock are making newspapers headlines nowadays. In that sense, economic policies including financial regulation and supervision are currently at a major juncture on an international scale.
You may remember that when the Chief Cabinet Secretary made an announcement on the Incubator Bank of Japan, there were talks about the Minister, the Senior Vice Minister, and the Parliamentary Secretary conducting an inquiry. Such voices from Ministers and the people, and above all, public confidence, are important for financial institutions. Especially since this issue dates back to the time when Mr. Takenaka served as Minister for Financial Services and Mr. Kimura served as consultant to the FSA, I have decided to establish in the FSA an inspection committee (inspection committee to examine administrative and other actions against the Incubator Bank of Japan) to restore confidence by properly revealing the facts to the general public. I am eager to share this with all of you today.
Your question strikes me as very much to the point. I believe that back in those days, the FSA also issued a banking license to banks other than the Incubator Bank of Japan, including Seven Bank and Sony Bank, and I have received a report stating that the processing time and other details in the Incubator Bank's case were not so different compared to those other cases. Still, considering that it is a case involving someone who was an advisor to the FSA – though he supposedly applied for the license after he resigned from that post – it evokes the saying "Suspicious haunts the guilty mind." As Mr. Heizo Takenaka was also a Diet member in addition to being a minister, I am of the opinion that the moral question should still be pursued in a proper fashion in dealing with this case.

Inasmuch as the candle produces water, and this gas comes out of the water, let us see what this gives us by the same process of combustion that the candle went through when it burnt in the atmosphere; and for that purpose I am going to put the lamp under this apparatus, in order to condense whatever may arise from the combustion within it In the course of a short time you will see moisture appearing in the cylinder, and you will get the water running down the side; and the water from this hydrogen flame will have absolutely the same effect upon all our tests, being obtained by the same general process as in the former case.
- Michael Faraday『ロウソクの科学』
From around noon today, I am scheduled to receive a briefing from the FSA staff on the double loan problem. Numerous questions have been asked about the double loan problem at the Budget Committee and I have replied to some of them. Forgive me for mentioning this over and over again, but basically, the FSA is responsible for inspecting and supervising private financial institutions. In principle, the financial source of private financial institutions is deposits entrusted by individuals - savings in the case of Japan Post Bank - and those funds must be repaid with interest in principle. Therefore, we will use the Act on Special Measures for Strengthening Financial Functions to increase capital. Under the Act on Special Measures for Strengthening Financial Functions, we will not pursue the responsibility of managers nor will we demand the setting of efficiency targets. As this is a once-in-a-millennium tsunami, the government needs to do its utmost to appropriately deal with it, rather than pursuing the responsibility of managers. In that sense, financial institutions should take appropriate actions in the Tohoku region.

In relation to the injection of public funds into Shinsei Bank and Aozora Bank, I have a technical question. The two banks hold public funds totaling 400 billion yen on a book-value basis. According to questions and answers made in the Diet about 10 years ago, in addition to the three principles set forth by the Deposit Insurance Corporation, a condition was imposed whereby the two banks should repay an additional amount of funds. Probably, the repayment amount will be around 580 billion yen compared with the book value of 400 billion. Unless their stock prices, which are slumping at low levels now, rise to fairly high levels, repayment will be difficult. Am I correct in understanding that there is not any change in the financial conditions for the repayment?
In particular, this week and next and in early November, there will be various movements in the financial sector - I am not talking about unexpected market developments, but about scheduled releases of various data - so perhaps, instead of scheduling a summit for a particular date, we should convene a summit or hold a telephone conference as soon as something has happened, although that may be difficult. However, the facts that neither Japan nor the United States rules out the possibility of holding a G-8 summit, and that Europe is positive about it, are evidence that a sense of crisis is shared by all countries, so neither I nor the Prime Minister would not rule that out.
As individual ministries and agencies have maintained strong powers in their areas of jurisdiction over the 65 years since the end of World War II, politicians, even the Prime Ministers, did not succeed in tearing down the wall of sectionalism. Mr. Yoshiro Mori (a former Prime Minister) supported the umbrella organization for kindergartens, while nursery schools basically had the support of Mr. Ryutaro Hashimoto. As nursery schools were divided into two groups, Mr. Hashimoto supported one of them and I supported the other. From my experience, I know that there was fierce sectionalism during the era of LDP government and the wall that separated ministries was really thick. I have the impression, based on my experience of spending my time in a governing party, an opposition party and a governing party again, that that situation has eventually led to the change of government. While I am ready to accept criticism straightforwardly, I believe that this must be done from the standpoint of the people following the change of government.
The other issue is to facilitate SMEs and regional companies. This has been addressed in the SME Financing Facilitation Act based on an unconventional financing approach. As I have been reappointed to Minister, I intend to work on the facilitation task in consideration of the social and public nature of the financial sector and the public interest it should fulfill. I am sure you are well aware that the Japanese economy is in an extremely tough situation at the moment. The first, second and third shots were taken by the Kan Cabinet in such circumstances, and especially given that SMEs in regional communities account for 99.7 percent of corporations in Japan, I intend to fulfill my duties properly by taking those factors into account.
I am aware that there are various reports appearing in newspapers. On a related note, it was announced at the Cabinet meeting today that Japan's unemployment rate is 5.1%. As it was, if I remember right, 5.0% last month, which means that there are approximately 3.3 million unemployed people, it is obvious that the economy, particularly employment, is in a situation not to be complacent about. Excuse me for repeatedly saying this but I, as part of my effort to determine how to deal with this Act, met with four SME business groups in Nagoya and Osaka and groups of small- and medium-size regional banks as well as shinkin banks, credit associations, etc. in the Nagoya and Osaka regions to listen firsthand to them frankly voice what they had to say. As I heard that SMEs are particularly in a grim business condition due to the high yen and other factors, we are in the process of examining the matter with the extension of the Act in mind as well.
I am aware that the Tax Commission determined in the primary assessment that it would not accept the request to extend the reduced tax rate for securities. At present, however, it is extremely important to overcome the recession due to deflation.
We also discussed the future management of the Basic Policy Cabinet Committee. I am not a man of precise mind and this committee discusses important policies and makes final decisions. Therefore, if we are to discuss specifics, it will be convenient to have support staff for the committee, as Ms. Fukushima (Social Democratic Party) and I are participating in the committee as the leaders of our respective parties, which are partners of the three-party coalition government. If I can hold appropriate discussions at the committee as the representative of my party, I would not need to discuss the same matter with my party officials again, so it would be better to appoint such support staff. The Chief Cabinet Secretary and the Deputy Prime Minister said they will consider appointing such support staff

Of course, I intend to do so. This is a matter of political leadership. Trade in agricultural goods has existed since the Meiji period; the rice market was opened in the Edo period. It is said that the first futures trading was conducted in Osaka. Grain trading has a very long history and tradition and it has been promoted by the former Ministry of Agriculture and Commerce and the Ministry of Agriculture, Forestry and Fisheries as part of the agricultural policy. Trading in crude oil and other mineral resources has been promoted as part of the trade and commerce policy. For my part, I served as parliamentary secretary for international trade and industry 20 years ago. However, regarding financial products, which account for most of the trading, futures trading is under the jurisdiction of the FSA. I am well aware that ministerial sectionalism has existed until now. The reality is that individual ministries have been operating on the basis of sectionalism. In this respect, we must exercise political leadership. Under the current economic strategy, it is an important task to strengthen the Tokyo market’s international competitiveness and enhance its position from a broad perspective, so the three relevant ministers will discuss this matter and take necessary actions.
As we have done every year, we selected cases from the inspection results reported from July of last year to June of this year and published them in the form of the latest Compilation of Problem Cases Raised in Financial Inspections for the 2009 program year, as you've just pointed out, which I expect each financial institution to refer to when formulating its future internal control system. With the successful enactment of the SME Financing Facilitation Act when former Minister Kamei was in office, it is now ensured, as you know, that in times of an economic downturn like the one we currently find ourselves in, financial institutions should adequately address requests for easing lending terms or changing housing loan terms, etc. In a sense, this has achieved a substantial change, if not quite a sea change, from the way financial administration was run in the past, and we need to keep that in mind. I know an SME owner in my hometown who employs about 100 people, about 50 of them being permanent employees and the rest working on a non-permanent basis, and who says that he is able to barely survive thanks to the establishment of the SME Financing Facilitation Act but also speaks out, "Mr. Jimi, we are now desperate for more work." He also goes on to say that "I personally feel that I could close down the business, but I am hanging on, struggling with all my might - because every one of my 100 workers has a family."
As you know, DPJ President and Prime Minister Kan and (PNP) Chief Kamei had a leader meeting the day following the day Prime Minister Kan assumed office, I believe, during which a decision to form a coalition was made. As I happened to be the Secretary General back then, I was also present at this meeting to witness, as I have explained, President Kan and Chief Kamei reach an agreement on creating an alternative to the Ministerial Committee on Basic Policies, which had been set up for the previous three-party coalition to coordinate their policies. This has not been done because everyone got a little busy in preparation for the election, as I have just talked about. Another point is that members of the PNP, being one of the parties in the coalition, have naturally raised voices requesting strongly that views of the party be reflected in the coalition. It is therefore not so much about the ceiling debate, although there are, of course, voices raised on the subject of ceilings, as it is simply natural that a coalition government should need to coordinate policies. That is what I reminded Prime Minister Kan of today, and he responded by saying that it is a matter of fact and telling Policy Research Committee Chair and Minister of State Gemba to create a proper system for it. While I did have a talk with Mr. Gemba later on, this is an issue between parties and I am sure that it will accordingly be handled properly, as it should be, by the Chief, or Secretary General or Policy Research Committee Chair of our party.
Furthermore, in the inspection and supervision of financial institutions, we take action in a stringent manner as necessary based on the confirmed facts pursuant to laws and regulations if violations of laws and regulations or problems in user protection are found as a result of on-site inspections, day-to-day supervision and other such activities. Likewise, we have endeavored to inspect and supervise the Incubator Bank of Japan in a stringent manner. The FSA had to properly conduct the first inspection and, in particular, the second inspection, according to law as an executive branch of government. Unless there is an obvious violation of law, an executive branch of government cannot take any arbitrary action. The third inspection, however, clearly revealed a violation of law as you know—what I am trying to tell you is that our action must be based on laws and facts. That is how an executive branch of government works. In that sense, although I can see at the emotional level why we are being criticized for not taking action earlier from the start, I believe as the head of an executive branch of government that regulation and supervision involves giving guidance based on objective facts in accordance with law, and should have as little room as possible for demands based on likelihood and arbitrariness. I believe this is an important quality for a person in charge of regulation and supervision based on laws and facts. Nevertheless, given that the Bank consequently failed, the FSA shall learn a lesson from this and continue to endeavor to stabilize the financial system.
As I said earlier, I, together with the BOJ's Governor, have requested relevant financial institutions to take appropriate measures that take account of the convenience of the disaster victims in a timely manner. In response to our request that branches be kept open on holidays, nearly 90% of the branches were open last Sunday. Also, financial institutions have paid out deposits even in cases where depositors have lost their certificates of deposit and passbooks if identification can be made in some way or other. I am also aware that they have taken other measures that take account of the convenience of disaster victims, such as flexibly responding to customers' requests for consultation about new and existing loans. Moreover, we have submitted a bill to extend the SME Financing Facilitation Act (Act concerning Temporary Measures to Facilitate Financing for SMEs, etc. I hear that as this was a once-in-a millennia tsunami disaster, various people in the region and the ruling and opposition parties have reached agreement. In order to ensure recovery from the disaster, financial institutions are making serious efforts to take various appropriate financial measures in a timely manner and are cooperating while listening to the voice of local communities, prefectural governors, municipalities, and associations of small and medium-size enterprises. The FSA will also continue efforts to take appropriate measures.
We have already entered the home stretch in the study, and at today's cabinet meeting, the cabinet members were instructed to select truly priority items (bills), as the period of the upcoming extraordinary Diet session is short, and we have already notified the Cabinet Secretariat of our bill with its tentative name. What we can do to support SMEs within the authority of the FSA is limited, and as I have been saying, it is necessary to envision the prospect of the overall economy and set the broad course of government policy for economic growth, and the moratorium scheme alone would not provide a hopeful prospect for SMEs; it is also necessary to take concrete measures to increase the jobs and revenues of SMEs and small shops. Therefore, it is very important to implement measures other than those that can be taken within the small areas of the FSA's administrative jurisdiction. As basic polices are to be decided by the Basic Policy Cabinet Committee, which is comprised of the Prime Minister, Minister Fukushima and I, I am in a position to be involved in implementing measures outside the FSA's narrow areas of administrative jurisdiction as cabinet policy. While I do my best in this respect, I will ensure the drafting of a bill that can stand against your criticism as a measure to support SMEs within my area of jurisdiction, as we still have more time till we submit the bill. Senior Vice Minister Otsuka's working group has entered the home stretch in its study on the bill, and it will fix the details based on opinions collected from various sectors.
I made a comment at the informal ministerial gathering today, which was obviously not a comment from the head of the administration, but I am Vice-Chief of the People's New Party (PNP), and the current government is, as you know, a coalition of the Democratic Party of Japan (DPJ) and the PNP. Accordingly, Prime Minister Kan, right after he assumed office, met with (PNP) Chief Shizuka Kamei to discuss how the two parties would cooperate in policymaking, at which meeting I was also present as the PNP Secretary-General at that time. Under the three-party coalition that preceded the current one, there was a committee called the Ministerial Committee on Basic Policies, which was set up as a forum for the parties to coordinate or match their policies, but then the Social Democratic Party left the coalition. That is why how the remaining parties should cooperate in policymaking afterwards was a subject of discussion at the party leader meeting right after Prime Minister Kan became the new Prime Minister, during which both leaders agreed to go about it properly. Then as it turned out, as you know, we had a House of Councilors election and the same subject also just came up again during the recent meeting of the two party leaders, who supposedly agreed to "do it (policy cooperation)." That is why I decided to make an elaborate comment on this subject to Prime Minister Kan at today's informal ministerial gathering, to which Prime Minister Kan responded by telling Mr. Gemba, who is a state minister and is also DPJ's Policy Research Committee Chair, to work on policy cooperation with the PNP in the proper way - therefore, Policy Research Committee Chair Gemba and I proceeded to discuss how it should be done, a task that I presume will basically be handled mainly by policy research committee chairs.
