I think that it is absolutely inappropriate that the United State and Europe, which previously urged Japan to carry out liberalization, as well as other countries, employ practices that are problematic under WTO rules and engage in protectionism now that the situation has become like this, and I think we must stop this by all means. All countries, whether they are in the WTO or in the G-7, have been saying all along and will continue to say that protectionism is not good. The registration of a mark shall be declared invalid at the request of any legally interested party if: the mark is registered in violation of Article 12; the mark is registered in the name of an industrial property agent or representative of the proprietor without the latter’s consent; the applicant has acted in bad faith when filing the application, that fact having been established by a valid court ruling; the use of a mark is liable to be prohibited by virtue of an earlier right of another person, that earlier right enjoying protection under another law, the mark consists of or contains the name of another person’s firm which was registered or used in the Republic of Bulgaria prior to the filing date of the application for registration in connection with identical or similar goods or services.  - 特許庁

(2) The owner of a prior right who has tolerated the use of a subsequently registered trademark for a period of five consecutive years with knowledge of said use may not later seek to have the subsequent trademark declared null and void or oppose the use thereof, on the basis of said prior right for the goods or services for which the subsequent trademark has been used, except where the application for the trademark has been made in bad faith, in which case action shall not be subject to prescription.
