In its judgment dated April 26, 2006, the Tokyo High Court (appeal trial judgment for the Bubka Idol case) stated that "it is not appropriate to argue that publicity rights and matters pertaining to infringement thereof shall be and superseded by the protection of freedom of expression simply because it is a publication Instead, the infringement of publicity rights should be analyzed, in consideration of the protection of freedom of expression in the sale of the publication, based on the circumstances such as the reputation, evaluation in the society, name recognition etc, whether the publication contributed to the promotion of its sale, and whether the utilization of such publication should be considered as an unauthorized utilization for commercial purposes." The approach taken by this judgment was slightly different from that consistently held since the King Crimson Case, which focused on whether the infringer "solely" utilized the celebrity's power to attract the customers' attention.

The subject of the financial regulatory reforms has already been a significant discussion topic in the past as well. I heard that during the Financial Ministers and Central Bank Governors meeting held from October 22 to 23 in Gyeongju, the proposed capital adequacy requirement for banks and a new liquidity framework, which were drawn up in a recent meeting of the Group of Governors and Heads of Supervision, were welcomed along with the commitment to having them come into full force by the prescribed due date, and an endorsement was given to the policy framework, work processes and timelines proposed by the Basel Committee on Banking, one of the subordinate organs of the Financial Stability Board, with respect to the issue of addressing systematically important financial institutions (SIFIs) that you have just raised. The meeting accordingly agreed to give priority to this initiative as an agenda item of the G20 Summit. In that sense, implementing international financial regulatory reforms will contribute to an enhanced financial system and improved soundness of financial institutions in the medium to long term. In the meantime, it is also extremely important to, among other things, make the set of requirements a well-balanced one that fully takes into account differences between countries in terms of the actual operation of their financial systems and to implement it over time by, for instance, allowing an ample planning time in adequate consideration of any impact on the real economy - this is also an approach that Japan applies in attending the ongoing Summit meeting.

Our teacher dedicated his life to the study requiring great pains; as to "Koshi-den", at the end of the Bunka era (1804-1818), he began to write the draft, and by the early Bunsei era (1818-1830), about 12 volumes had been completed; however, by that time, he had also gradually gained an insight into the study and understood the teachings of the master of Suzunoya (Norinaga MOTOORI), then he realized that this world was the product of our great gods of Japan, so he decided to suspend "Koshi-den" temporarily, and first explore and read through all the past annotations of the histories of our country as well as those of India and Europe to use new knowledge to his advantage in writing "Koshi-den"; therefore, since the middle of the Bunsei era, he intensly studied foreign literature and culture mainly, and during a period of over 20 years, he completed almost all his works, which he left for us, including "Sekiken Taiko-den" (Japanese Early History); although he was never satisfied with his works, his students, of course, including myself, with a feeling of gratitude, thought that our master had succeeded in completing most his researches and studies, and were concerned about the delay in completing "Koshi-den" and because of our master's age, we repeatedly begged him to restart the writing, then thankfully at about the 10th year of the Tenpo era (1839), he restarted; however, he was requested to write on linguistic methods so he began to write "Goju Ongi" (Pronunciation and Meaning of 50 Kana) and suspended "Koshi-den" again; after a year, he was banished to Akita Province by order of the former bakufu (Japanese feudal government headed by a shogun), fortunately since Akita was his hometown and there were many relatives of his, besides the former load treated him very kindly, they relieved him off poor living, although under those conditions, he had no time to finish the remaining works; he was always concerned about those unfinished works, and after only a few years, he became sick and regrettably died.

In this context, if we are to proceed with postponing the expiration of the Act, we will properly request various organizations to submit data or conduct interviews with them. When I served as Parliamentary Vice-Minister of International Trade and Industry twenty years ago, I was in charge of SMEs as required as the Parliamentary Vice-Minister of International Trade and Industry appointed from the House of Representatives back then for one year and three months under (former) Minister of International Trade and Industry Eiichi Nakao. Based on such experience, I have been told by SMEs how extremely helpful the Act has been. I may have also told you previously that according to what I have been informed by bureaucrats, a megabank attended a gathering of various financial institutions-a gathering of shinkin banks and credit unions at one of the financial bureaus-for the first time ever since the establishment of the Act. In that sense, my intuition as a politician is that the Act is proving to be extremely effective against the backdrop of the strong yen at this stage when we are considering the possibility of postponing its expiration.

According to some books, the reason why TAKECHI treated Izo coldly in his later years was, for example, from the discriminative feeling for Izo who had low social standing and no education compared with the other comrades, a sense of danger that exposure of many of the assassinations that Izo took part in may have unfavorable effects to his fellow comrades, and resentment and anxiety toward Izo for not taking his own life although those exposures could be prevented if he had committed suicide; furthermore, even if he had been a member of the Tosa kinnoto that aimed for "Sonno Joi (19th century slogan advocating reverence for the Emperor and the expulsion of foreigners) and overthrowing the Shogunate", he became a bodyguard to Kaishu KATSU (to be explained later) who was "a member of the open country wing and a vassal of the shogun"; Izo was disdained, for "although skillful in swordplay, he was a man with no resolute ideas and beliefs."

After the mid Heian period, such direct access to the emperor was only allowed to the Abe clan whose hereditary occupation was tenmon hakase and the Nakahara clan which was kyokumu (the chief secretary of the Daijokan, or Grand Council of State); incidentally, the Nakahara clan had assumed the role of tenmon misso from Mochitada NAKAHARA in the tenure of Emperor Daigo (afterwards in 972, he was granted the family name of NAKAHARA along with Uzo NAKAHARA [中原] of the head family and originated the clan), allegedly because, besides the clan's hereditary occupation of Geki [Secretary of the Grand Council of State], it inherited the family learning of Myogo-do [the study of Confucian classics] and used many Chinese classics as source books, many of which contained elucidation of astronomical phenomena so that the clan produced many persons well versed in tenmondo.

Under these circumstances, of course, there is a broad range of policy themes for this election campaign, including foreign policy and national security, as well as fiscal policy, and what to do with the social security system in relation to the declining birth rate and the aging of society. In my view - I say this perhaps because I am a minister in charge of economic affairs - the greatest focus of interest for the people is what economic measures should be taken amid the downside risks for the economy due to the surging prices of crude oil, raw materials and foods, and how Japan's economic situation should be changed. I will pay attention to this point when making a final decision.

As I informed you when I met with US Federal Reserve Board (FRB) Chairman Ben Bernanke, the Governor of the People's Bank of China Zhou Xiaochuan and other governors of central banks in August 2010, financial institutionsespecially banks engaged in international operations—will certainly become more stable if they have more capital. In Japan, however, both public and private sectors had a very bitter experience during the financial crisis 12 years ago. Looking back, even sustainable companies that would otherwise have been sound were forced into bankruptcy due to the widespread credit crunch and credit withdrawal resulting from financial institutions seeking to secure capital temporarily, and the damage incurred was particularly extensive among small- and medium-sized enterprises (SMEs). At the time, the Nikkei Average looked as though it was about to fall below 7,000 yen, so Japan's argument based on such experience has been reflected in the G20 Summit declarations to date and the agreement announced at the recent meeting of the Group of Governors and Heads of Supervision.
